In General
For the criminal allegation of Indecent Exposure, it is irrelevant how many persons were exposed to the alleged behavior. The act of breastfeeding or expressing breast milk is explicitly exempted from the Indecent Exposure offense. Indecent Exposure may be punishable as a Simple Misdemeanor, Gross Misdemeanor or Class C Felony depending on the circumstances.
Indecent Exposure – Simple Misdemeanor
Indecent Exposure is the knowing and intentional making of an open or obscene exposure of his or her person, while knowing that such conduct is likely to cause reasonable alarm. Reasonable alarm is not necessary to have actually occurred, just the likelihood of it occurring. “Reasonable alarm” is not defined.
When charged as a Simple Misdemeanor, Indecent Exposure is punishable by up to 90 days in jail and/or a $1000 fine.
Indecent Exposure – Gross Misdemeanor
Indecent Exposure is chargeable as a Gross Misdemeanor when, as a first offense, the person charged allegedly exposed him or herself to a person under the age of 14 years.
Indecent Exposure – Class C Felony
Indecent Exposure is chargeable as a Class C Felony when the person charged allegedly exposed him or herself to a person under the age of 14 years, and the person charged has a prior Indecent Exposure conviction or a conviction for any other sex offense.
